Here’s how the Social Security Administration gathers court admissible evidence of your CIVIL “U.S. citizen” election during the retirement process:
- Submit the SSA-1 Application
1.1. Fill out the Application for Retirement Insurance Benefits, Form SSA-1 signed under penalty of perjury.

1.2. Apply online:

- Conduct a phone interview that is recorded by the Social Security Administration (SSA). During the interview, they warn you that you are under Penalty of Perjury.
- They then send you a written transcript of the recorded conversation and give you 10 days to dispute or correct it. See:

Warning: The SSA website advertises applications 86% competed “within two weeks or on time”. Clever wording..”on time.” That means NOT two weeks. From what I understand they’re trying to go all on-line.
Expect them NOT to read a paper application and add months to any application time. Eventually they just schedule you for a phone interview and take your application over the phone trying to ignore the paper application.
One member actually did a DOUBLE TAKE when the phone interview transcript comes back with “citizen of the United States”. Expected “U.S. citizen”.
When you talk with them during the interview, this is how we would handle it:
I’m going to pay them a visit and take in my last ___ years of 1040NR tax returns and ask:
“As a U.S. citizen with the SSA, how do I ensure I get a 1042S commensurate with my NRA tax status when I receive SS payments?”
That oughta freak ‘em out.
2. Social Security Scam Generally
The scam literally hits the dead end there!
- The “United States”**** in the Social Security Act at 42 U.S.C. 1301 also includes the territories and possessions.
- The Social Security POMS says in RS02002.010 says American Samoans are “U.S. nationals”

This proves they are operating under the context of domestic national CIVIL jurisdiction rather than national POLITICAL jurisdiction.
We know this is true because American Samoans aren’t U.S. citizens POLITICALLY, but non-citizen nationals. See 8 U.S.C. §§ 1408 and 1452.

3. How One Member Handed the above Process In His Own Words
I redefined US citizen solely & exclusively to “birth in _________” on the paper form. He didn’t say a word about it on the interview and I kept reiterating, everything references the paper application which he said was ok.
But The written summarization then came back saying I stated i was a citizen of the US giving 10 days to correct. The very next Day I dropped off a correction at the office saying,
“Your form requires a testament to truth. That must be my truth. I can only state what I know to be true and can prove to support eligibility requirements. And that is I am in possession of a birth certificate indicating my birth in __________–attached. I am not a lawyer authorized to interrupt federal laws for federal forms and what implications my declaration might be for your truth or that of the SSA..”
I also referenced in the written application and correction a “religious accommodation citizenship in heaven” (Philippians 3:12)…and a reference to rights and free inhabitant entitlements in the 1st two organic laws. Now ironically just 10 mins after I dropped off the correction, I checked the on line status and it said “approved”.
BTW: I also did the “yes is my yes” affirmation religious accommodation rather than Penalty of Perjury (POP). If it all works, I’ll send you a sanitized version. The trick is the paper form because they have 1 whole blank page devoted to remarks…so I just took the Question numbers and clarified and redefined terms.
